CROSSVILLE —
A Crossville area woman entered an Alford plea in a case in which she was charged with rape of a child, sexual battery by an authority figure and another sex-related offense.
Nicole A. Woody (Susong), 35, entered a "best interest" plea to attempted aggravated child abuse during a hearing last week in Cumberland County Criminal Court.
While not saying she was guilty of the lesser offense, Judge David Patterson explained that the court would only recognize the plea as one of guilty. Charged under the name of Woody, the defendant said she understood how the plea would be recorded.
Woody will have a sentencing hearing on May 11 at 1 p.m. at which time it will be determined how a four-year sentence will be served. She has made application for pre-trial diversion.
The incident for which she was charged occurred between Feb. 18 and 24 of 2010 and involved a victim nine years of age at the time.
State prosecutors told the court that one of the reasons for the sentencing agreement was inconsistencies in the victim's recollection of events, and that victim's family was in agreement with resolution of the case.
