Woman must pay $1,564 restitution to housing authority

A woman who was accused of applying for and receiving services from the Crossville Housing Authority for which she did not qualify pleaded guilty in Cumberland County Criminal Court recently and may qualify for diversion if she completes probation requirements.

Pamela Marie Hudson, 25, was charged with theft more than $1,000 in the case. The charge is a class D felony and Hudson could have received a two- to four-year prison sentence and a fine up to $5,000.

In exchange for her plea of guilty, Hudson received a two-year suspended sentence to be served on probation. Her probation will be extended if she has not paid $1,564 in restitution to the Crossville Housing Authority.

Once restitution is paid and she completes other requirements of probation, she may then petition the court to have her case placed under judicial diversion which would later allow her to have the charge removed from her permanent record.

In other cases, the following action took place.

Guilty pleas

•Jimmy Bowman Sr., 61, possession of cocaine for resale, pleaded guilty to possession of less than .5 grams of cocaine for sale and received a three-year suspended sentence to be served under house arrest of community corrections, fined $2,000 and court costs.

•Charles Dewayne Conatser, 36, rape, pleaded guilty to aggravated statutory rape in an agreed amended indictment and received a three-year suspended sentence to be served on probation. He must also register on the state sex offender registry.

•William Joseph Eaton, 29, manufacture of methamphetamine, possession of an altered driver's license, theft more than $1,000 and theft more than $500, pleaded guilty to attempt to manufacture meth and received a six-year suspended sentence to be served on probation, was fined $2,000 and court costs. Also pleaded guilty to theft more than $1,000 and received a four-year suspended sentence, to run consecutive to the meth plea, for a total of 10 years on probation. Remaining charges were dropped.

•Shawnad Louise Flowers, 39, forgery and passing a forged instrument, pleaded guilty to forgery and received a two-year suspended sentence with ten days to serve on weekends and the remainder on probation. Fine was waived. To pay $85.15 restitution.

•Terry Joe Hawn, 25, possession of a schedule II drug for resale and possession of a handgun for the purpose of going armed, applied for judicial diversion which will be decided April 14. If diversion is not granted, he will received an 11-month and 29-day suspended sentence to be served on probation with 100 hours of community service to perform, alcohol and drug assessment and fined of $750 and court costs.

•Jamie A. Hinds, 33, charged with theft more than $1,000, pleaded guilty to theft less than $500 and received an 11-month and 29-day suspended sentence to be served on probation until the $3,500 restitution is paid in full.

•Jennifer Lynn Horine, 34, possession of cocaine and possession of drug paraphernalia, pleaded guilty to attempt to possess cocaine for resale and received a four-year suspended sentence to be served on probation, was fined $2,000 and court costs, and must perform 100 hours of community service. Second charge was dismissed.

•Brian Paul Jolley, 21, charged with burglary, three counts of auto burglary, four counts of theft more than $500 and vandalism more than $1,000, pleaded guilty to burglary and received a four-year suspended sentence with 120 days to serve and the remainder on probation. He pleaded guilty to auto burglary and received a two-year suspended sentence with 120 days to serve and was ordered to pay $455 in restitution. He pleaded guilty to theft more than $500 and received a two-year suspended sentence with 120 days to serve, all sentences to run consecutively. All remaining charges were dropped.

•William Greg Mills, 21, charged with domestic assault, pleaded guilty to the charge and was sentenced to time already served. He is to also pay any restitution that is owed.

•Eric V. Parker, 30, charged with theft more than $1,000, pleaded guilty to the charge and received a three-year suspended sentence to be served on probation, and was fined $500 and court costs.

•Gregory Aaron Reppert, 22, charged with domestic assault, pleaded guilty to the charge and received an 11-month and 29-day suspended sentence to be served on probation, was fined $250 and court costs.

•Serena K. Weaks, 39, charged with theft more than $1,000, pleaded guilty to the charge and received a three-year suspended sentence to be served on probation and was fined $500 and court costs. She must also pay $1,155 restitution.

•Clifford Ray Campbell, three counts of rape of a child, motion deadline set for March 3; set for trial March 4.

•Mark Allen Byrge, aggravated assault with a weapon and felony reckless endangerment, set for trial March 26.

•David Michael Schultz, attempted arson and vandalism more than $1,000, set for trial April 15.

•Gordon Lee Weaks, violation of the sex offender registry law, set for trial April 16.

•Jack A. Cresap, aggravated sexual battery, motion hearing set for March 3; trial set for April 24.

•Avery L. Davenport, motion hearing set for May 23; set for trial June 4.

•Steven James Lambers, robbery, felony possession of a handgun and resisting arrest, motion hearing set for March 10; set for trial June 5.

•Avery L. Davenport, aggravated kidnapping and aggravated rape, motion hearings set for May 23; set for trial July 14.

•Jack W. Brumbalough Sr., first-degree murder, felony murder and especially aggravated robbery, set for trial July 28.

Deadline docket

•John J. Sexton, aggravated child abuse of a victim under the age of six, bond denied; continued until Feb. 15.

•David Darnell Todd, possession of drug paraphernalia, dropped.

•Roger Dale Floyd, simple possession of cocaine and simple possession of marijuana, continued until March 17 at which time defendant is to return to court with an attorney.

•Timothy W. DeBord, theft more than $500, criminal summons issued.

Return with attorney

•Cheryl Ann Brown, prescription fraud, continued until April 14.

•Velma Earlene Emerson, filing a false report, continued until May 9.

•George Ed Erwin Jr., promotion of the manufacture of methamphetamine, continued until March 17.

•Aaron Joseph Ewing, theft more than $500, continued until March 17.

•Melinda F. Farr, three counts each of forgery and passing a forged instrument, continued until March 17 at which time defendant is to return to court with an attorney.

•Elvin L. Ford, twelth offense driving on a revoked license, continued until March 28 at which time defendant is to return to court with an attorney.

•Dustin Nathaniel Galo, theft more than $1,000, continued until March 17 at which time defendant is to return to court with an attorney.

•Andrea L. Greatorex, manufacture of more than 20 marijuana plants and possession of marijuana with intent to sell or deliver, continued until April 14.

•Michael K. Hensley, child abuse, continued until May 9.

•Timothy Neal Hilton, third offense driving under the influence, continued until March 28.

•John M. Myers, driving under the influence, continued until March 28.

•Angela Sherrill Smith, aggravated burglary, theft more than $1,000 and vandalism less than $500, continued until March 17.

•Marshall Condon True, theft more than $500, continued until March 17.

•Christopher Eric Vaughn, theft more than $1,000, continued until April 14.

Motions and hearings

•Derrick Christian Bradley, burglary and theft more than $10,000, motion for termination of pre-trial diversion denied; diversion extended six months from this court date.

•Donna M. Brady, nine counts each of forgery and passing a forged instrument, to remain on probation until court costs and restitution are paid.

•Frank E. Davidson, sixth offense driving unde the influence, violation of the habitual motor vehicle offender law and driving on a revoked license, continued until May 9.

•Douglas E. Mackie, motion for new trial on theft or more than $1,000 conviction, set for April 14.

•Tara Jean Reeves, burglary, theft more than $500 and drinking below the legal age, continued until May 9 for status monitoring.

•Jeffery L. Tabor, motion to reduce sentence in two sale and delivery of methamphetamine and possession of meth with intent to sell or deliver cases, forfeiture and capias issued for failure to appear; ordered held for bond hearing.

•James Steven Walker, motion to waive fines and court costs in marijuana and drug paraphernalia cases denied; continued for monitoring to March 17.

•Matthew David Ward, motion to expunge statutory rape charge from record granted.

Probation violations

•Lee Ann Matthews, probation revocation hearing continued until May 9.

•William N. Prescott Jr., on probation because of third offense drunk driving and revoked license charges, had probation extended one year.

•Brian Paul Jolley, on probation because of assault on an officer, criminal impersonation and theft of government property charges, to serve 120 days in jail for probation violations.

•Bryan Anders Tollett, on probation because of aggravated assault on an officer, resisting arrest and possession of drug paraphernalia convictions, had his probation revoked and was placed in jail for 30 days and then to be released into the community corrections program.
