CROSSVILLE —
A deputy responding to a dispute between a landlord and a tenant found himself on the wrong end of a flailing elbow, resulting in the arrest of the landlord during an incident that occurred Saturday morning.
Timmy Lynn Miller, 51, 1023 Breckenridge Rd., is charged with assault on an officer, resisting arrest and simple possession of a legend drug, according to Deputy Dustin Jackson's report.
Jackson responded to 2516 Ryan Rd. on a report of a landlord threatening to shoot residents inside a rental house, the deputy wrote in his report.
"When I came in contact with Timmy, he became extremely belligerent and threatened the residents inside the household," Jackson reported. He reportedly checked Miller for weapons before approaching the house where David Rose and his family were standing.
As the deputy attempted to interview the victims, Miller is alleged to have continued his verbal assault on Rose, and at one point allegedly threatened to harm both Rose and the deputy.
Jackson decided it would be best of the safety of all present that Miller be detained during his investigation into the complaint, and when he attempted to place handcuffs on Miller, the suspect allegedly attempted to strike the deputy in the face with his elbow.
A struggled ensued and only ended with the officer using a chemical spray to disable the suspect.
At the county jail, a correction officer found the suspect in possession of Diazepam and charged Miller with simple possession of a controlled substance.
Miller was jailed in lieu of $6,000 and was advised how to properly remove tenants from his property.
